Terms and Conditions

All Internet advertising and marketing undertaken with indie-cds.com (the vendor), is subject to the following terms and conditions. By submitting your items for sale with indie-cds.com, you, the client, agree to be bound by these terms.The client agrees to:

  • keep indie-cds.com supplied on request with a minimum stock level of ten units of each titem listed (or other quantity as agreed) (Costs of delivery of items to indie-cds.com are the artist's responsibility.)
  • supply replacement stock items promptly - within seven days of request ideally. (Indie-cds listings that are out of stock and where the artist does not re-supply within 28 days may be cancelled without refund. Amazon listings that are of stock are automatically cancelled.)
  • replace faulty goods promptly and free of charge to indie-cds.com
  • pay re-boxing fees for CD and DVD cases that arrive at indie-cds damaged due to inadequate packing
  • if sound files are to be provided by indie-cds, to waive any requirement for royalties to be paid by indie-cds on sound sample audio files on our internet sites
  • if the client wishes to have music featured on our webradio, to waive any requirement for royalties to be paid by indie-cds on our webradio programming
  • link to the indie-cds listings from the client's own website(s), and, to test and maintain that link or links in working order, and to mention indie-cds.com as web distributor for their items in a prominent manner on their website(s)
    • The vendor (indie-cds.com) agrees to provide;
  • web page design testing and uploading for one catalogue entry in each of the clients selected catalogue options (amazon, retail and wholesale) per item.
  • where no online audio is provided by the client, and where the client agrees to waive music royalties for that sound sample, indie-cds will provide one sound sample on site in RealAudio format of one to two minutes
  • scanning of one cover image, layout, text and image editing from internet copy, email or MS Word format originals..
  • mail order and Internet marketing and despatch services, charged on a commission basis as shown in our current scale of fees
  • orders will normally be despatched within 2 business days of receipt by us
    • Extras:
  • text input/scanning from typed or word-processed paper copy may be charged as an extra
  • Listings that do not sell two copies in a calendar year may be subject to a discretionary re-listing fee of A$10 payable in Jan each year. Non-payment of the re-listing fee will result in cancellation of the listings.
  • If we have to replace damaged CD or DVD cases a charge per item applies, as shown in our current pricing schedules
    • Invoicing and payments
  • payments for sales made by indie-cds.com will be made every 3 months by direct credit or cheque for Australian clients, or via Paypal for clients elsewhere.
  • invoices for any other services rendered by indie-cds.com are payable within 28 days. An accounting fee of 10% of the invoice amount will be added to accounts which are not paid within this time.
  • charges may be reviewed at any time, though existing agreements are valid for the current calendar year without increases.
  • commission rates and other charges may be varied according top market conditions. Notification of these changes is made by updating our website pricing page. The onus is on artists to check this periodically as individual notifications about such changes are not practical.
    • Postal losses and mistakes on orders
  • indie-cds.com is not responsible for any damage which may occur to stock sent by clients to indie-cds. It is the responsibility of the client to pack items with care. If CD cases have to be replaced because of damage we reserve the right to deduct these costs from money due to clients for sales
  • indie-cds.com is not responsible for postal losses which may occur on customer orders. Only purpose-made Australia Post CD mailers are used for mailouts, and every care is taken to pack, label and seal items properly. While postal losses are very rare, every now and again items do become lost in the mail. If this occurs, and we are unable to recover the cost from the carrier, the artist will be liable to cover the cost of a free replacement item. indie-cds.com will be liable only for the replacement of packaging and mailing the items again and the cost of processing the order
  • We may at our discretion choose to replace items for customers at our own cost if we have made errors in sending wrong items, or otherwise mis-handled orders.
    • General
  • artists and bands will only be listed at the discretion of indie-cds.com
  • artists may market using a maximum of two other onlinedistributors, unless indie-cds.com is given PREFERRED RETAILER status on the artists website. Preferred retailer status requires clearly showing on your page where you sell your CD that Indie-CDs.com is your Preferred Internet Retailer.
  • artists may terminate the arrangement at any time, giving four weeks notice, and request the return of unsold stock. All promotional stock supplied to indie-cds is NON RETURNABLE and Listing Fees and Site Joining fees are NON-REFUNDABLE
  • The onus is on the artist to check these terms and conditions pages from time to time to keep up to date with any changes that may be needed to ensure the viability of the Indie-CDs website.
    • Editing and house style
  • all artist entries and product page entries will be edited to conform to the house style of the indie-cds.com website, generally using standard Australian English spelling and grammatical construction. Offensive, obscene or potentially libellous material will not be included. Text and image layout styles will be at the discretion of indie-cds.com

    Agreement - Placing stock for sale with www.indie-cds.com requires full acceptance of the above terms
